    "A Georgia judge yesterday approved an effort by former President Trump and his co-defendants to appeal the decision to allow Fulton County District Attorney Fani Willis to continue to prosecute the 2020 election subversion case there. Fulton County Superior Court Judge Scott McAfee, who ruled last week against the defendants’ efforts to disqualify Willis, issued a certificate of immediate review, allowing the case to be revealed by a Georgia Appeals Court. The move does not pause the prosecution but allows appeals on the disqualification effort to play out before trial. Jason Morris and Zachary Cohen report for CNN."

    "Former President Trump and his adult sons face a deadline today to pay or secure a bond for the $464 million judgment in Trump’s civil fraud case, which their lawyers have called a “practical impossibility.” If he cannot get a bond, New York Attorney General Letitia James could begin the process of seizing Trump’s prized assets.     Trump is expected back in court today for what is likely the final hearing before his New York hush money criminal case goes to trial. The case, which was initially scheduled to begin jury selection today, was adjourned for 30 days by Judge Juan Merchan after defense attorneys raised issues with federal prosecutors’ late production of potential evidence. Today’s hearing will resolve a recent defense motion related to the potential evidence and set a final trial date. Aaron Katersky and Peter Charalambous report for ABC News."

    "It was a tale of two New York legal threats for DONALD TRUMP today, as he scored a major (if temporary) reprieve in his civil business fraud judgment but failed to stave off his first criminal trial any further.

    THE HUSH MONEY CASE: As an unhappy Trump sat in the courtroom in Manhattan, Justice JUAN MERCHAN delivered the news the former president had tried to avoid: He will go to trial April 15 on charges that he falsified business records to cover up a hush money payment meant to hide his affair with porn star STORMY DANIELS during the 2016 election.

    The 34 felony charges in this case, from Manhattan DA ALVIN BRAGG, are the least grave of any of the four criminal imbroglios Trump faces this year, but it’s now set to be the first — and possibly only — to go to trial before the November election.

    Merchan shot down arguments from Trump’s attorneys that a recent federal document dump warrants further delays, declaring that the “defendant has been given a reasonable amount of time,” and seemed frustrated with their arguments — a warning sign for Trump.

    April 15 will now be a historic date as jury selection kicks off and Trump becomes “the first American president to stand trial,” the NYT notes.

    THE CIVIL BUSINESS FRAUD CASE: Meanwhile, a panel of appellate judges gave Trump and the other defendants 10 days of breathing room, extending the deadline for them to post bond for the corporate fraud judgment and reducing the amount they need to cover from $454 million to $175 million. Trump told reporters today that his collateral on the bond was cash. Details from Erica Orden in New York

    Trump now has more time to try to hold off New York AG TISH JAMES from collecting on the massive penalty he incurred for fraudulent practices at the Trump Organization, which undercut the core of his public persona as a successful businessman. James had set today as the end of her monthlong grace period for Trump to find the money before she began to collect (perhaps through asset seizures). But Trump’s legal team said last week they failed to find anyone to put up a bond for the $454 million judgment, despite asking dozens of underwriters, and asked for a $100 million bond instead.

    Today’s brief order from a panel of five judges says Trump can put up less than half that amount as his appeal proceeds. They also stayed parts of the lower-court ruling that blocked Trump, DONALD TRUMP JR. and ERIC TRUMP from some elements of practicing business in New York. Read it here"

Meanwhile, the man found guilty of fraud is now the major shareholder in a publicly traded company and just added billions to his net worth. What exactly is creating value in this newly public company? That's unclear. "Trump Media brought in less than $3.5 million in revenue in the first nine months of 2023, while posting a $49 million net loss in the same period." As far as I can tell, he’s going to pay for his fraud with an even bigger fraud. If this doesn't work, there's always the bibles he started selling today. It's incredible that anyone would buy anything from this guy."

    Former President Trump lashed out yesterday at the New York judge who put him under a gag order ahead of his April 15 hush money criminal trial, making a false claim about the judge’s daughter and urging him to step aside from the case. Trump claimed that Judge Juan Merchan’s daughter had recently posted a photo on social media depicting her “obvious goal” of seeing him jailed. A statement from the New York’s state court system said Trump’s claim was false and that the social media account Trump was referencing no longer belongs to Merchan’s daughter. Michael R.     Former President Trump’s lawyer yesterday argued for the Georgia election interference indictment to be dismissed on free speech grounds. In the ongoing hearing in Atlanta, Steve Sadow said the charges related to election interference were attempting to criminalize speech protected by the first amendment. “The reason why we don’t even get to a trial is because it’s unconstitutional to force an accused … to stand trial on protected speech,” Sadow said.     The judge overseeing Trump’s criminal hush money case has expanded his gag order after Trump posted online attacks about the judge’s daughter. On his social media platform Truth Social, Trump wrote that Justice Juan Merchan’s daughter was a “Rabid Trump Hater” who “admitted to having conversations with her father about me, and yet he gagged me.” Judge Merchan wrote in his ruling, “It is no longer just a mere possibility or a reasonable likelihood that there exists a threat to the integrity of the judicial proceedings. The threat is very real … It merely injects fear in those assigned or called to participate in the proceedings, that not only they, but their family members as well are ‘fair game’ for Defendant’s vitriol.” Kayla Epstein reports for BBC News.

    The only part about this I take issue with is the “likely to” clause.  Seems like the cliff happened a long time ago, and we’ve all been dealing with the consequences for years.

    A Manhattan judge yesterday denied Trump’s attempt to delay the start of his New York hush money trial, court records show. Trump had asked to delay the trial, set for April 15, until the Supreme Court rules on his presidential immunity claims. Judge Juan Merchan wrote that Trump had “myriad opportunities to raise the claim of presidential immunity well before March 7, 2024.” “Defendant’s motion is DENIED in its entirety as untimely,” Merchan wrote.
