    On Monday, a federal judge blocked Trump’s effort to make employers pay a $100,000 fee if they seek to hire foreign workers for specialized roles.     Thursday TRUMP ADMINISTRATION LITIGATION 

    A federal judge in Washington yesterday declined to issue a temporary restraining order to prevent Trump’s “anti-weaponization” fund from being set up and disbursing payments. The judge said the lawsuit appeared to be moot in light of statements by administration officials that the fund is not proceeding. A federal judge overseeing a separate lawsuit in Virginia has already temporarily blocked the administration from establishing the fund. Josh Gerstein reports for POLITICO.  

    19 Democratic states and Washington, D.C., filed a lawsuit yesterday claiming federal agencies have flouted the law by hastily implementing Trump’s executive order that seeks to eliminate diversity, equity, and inclusion initiatives by federal contractors. The lawsuit claims that more than two dozen federal agencies are adding terms to federal contracts barring “any racially discriminatory DEI activities” without notice or explaining what is prohibited.     The Justice Department declined Friday to submit sworn declarations from senior administration officials confirming that the proposed $1.8 billion “anti-weaponization” fund will not proceed, after Judge Leonie Brinkema said she would otherwise set a litigation schedule and require a responsive pleading by July 17. DOJ argued that declarations from Acting Attorney General Todd Blanche, Treasury Secretary Scott Bessent, and Associate Attorney General Stanley Woodward were “unnecessary,” that compelling statements from senior executive officials “implicates serious separation of powers concerns,” and that Blanche’s congressional testimony and DOJ court filings already carried serious penalties for falsity.     Over the next two weeks, the Supreme Court will clear its docket before its summer break, making decisions on four major cases concerning Trump’s push to expand his power. “The justices are weighing whether Trump can redefine birthright citizenship, fire a governor of the Federal Reserve, consolidate power over independent agencies and strip protections from hundreds of thousands of immigrants,” writes James Romoser for the Wall Street Journal. 

    In a decision that was unsealed on Monday, a federal judge blocked Justice Department grand jury subpoenas aimed at Tim Walz, the Democratic governor of Minnesota, and his allies. “Initiating a criminal investigation in order to harass political opponents or to coerce them into taking official action — particularly official action that the federal government cannot directly require those political opponents to take — is a blatantly unlawful and unethical use of the grand-jury process,” U.S. District Judge Patrick Schiltz wrote in his ruling.     A different federal judge blocked the Trump administration’s effort to create a voter-screening database using millions of Americans’ private information, including their Social Security numbers and citizenship status. In a ruling released Monday, U.S. District Judge Sparkle Sooknanan said the federal government “has knowingly trampled on the privacy rights of American citizens in a manner that threatens the sacred right to vote.” Sooknanan said the administration provided inaccurate data to states, leading to voters being “wrongfully identified as non-citizens” and then having their voter registrations canceled.     The Justice Department has withdrawn subpoenas it issued this spring to force journalists at the Washington Post and the Wall Street Journal to testify before a grand jury. The subpoenas targeted reporters who cover national security, including the Washington Post’s Ellen Nakashima. Trying to force journalists to testify under oath before a grand jury marks a new escalation in the administration’s attempts to control the media.     Three International Criminal Court judges sued the Trump administration Wednesday in federal court in Manhattan, challenging sanctions imposed on them last year after ICC actions involving Israeli Prime Minister Benjamin Netanyahu and alleged U.S. war crimes in Afghanistan. The judges argue the sanctions exceed the International Emergency Economic Powers Act and were designed to punish and pressure them for judicial decisions, leaving them unable to use banking, travel, online, and some health insurance services.     A federal judge Wednesday dismissed the Justice Department’s sanctuary city lawsuit against Newark, Jersey City, Paterson, and Hoboken, holding that DOJ lacked standing to challenge local policies that largely mirror New Jersey’s statewide Immigrant Trust Directive. U.S. District Judge Evelyn Padin said the statewide directive would remain in effect even if the city policies were invalidated, and that any differences DOJ identified were too minor or speculative to keep the case going.     The Supreme Court yesterday upheld a Mississippi state law allowing mail ballots to be received up to five days after Election Day, delivering another setback to Trump’s wide-reaching campaign to change election laws.
