Trump likely exceeded his authority by issuing an executive order containing a number of changes to electoral procedures, including new stringent voting ID requirements, a federal judge found on Friday. The judge issued a preliminary injunction restraining the federal government from requiring proof of citizenship for new voters and blocking a directive for Attorney General Pam Bondi to take action against states that continue counting ballots beyond Election Day. The Tyrant Test

For as long as I’ve been alive, American presidents have defined tyrants by their willingness to use military force against their own people in reprisal for political opposition. This was a staple of Cold War presidential rhetoric, and it survived long into the War on Terror era.

Ronald Reagan declared in 1981 that “it is dictatorships, not democracies, that need militarism to control their own people and impose their system on others.” His successor, George H. W. Bush, did the same in 1992, talking about American presidents confronting the Warsaw Pact, which had been “lashed together by occupation troops and quisling governments and, when all else failed, the use of tanks against its own people.” Bill Clinton, when justifying strikes against the Iraqi dictator Saddam Hussein in 1998, emphasized that Hussein had used his arsenal “against civilians, against a foreign adversary, and even against his own people.” George W. Bush repeated that justification when invading Iraq in 2003, saying that Hussein’s government “practices terror against its own people.” Barack Obama, when intervening in Libya on behalf of rebels fighting Muammar Qaddafi, warned that Qaddafi had said “he would show ‘no mercy’ to his own people.”

It would be absurd to say that American presidents have always been principled defenders of freedom and democracy, but their long-shared, bipartisan definition of tyrant is one who oppresses his own. So it’s striking that these warnings about tyrants in distant lands, who were supposedly the opposite of the kind of legitimate, democratic leaders elected the United States of America, now apply to the sitting U.S. president, Donald Trump. It is a simple but morally powerful formulation: A leader who uses military force to suppress their political opposition forfeits the right to govern. You could call this the “tyrant test,” and Trump is already failing it."

The Trump administration’s cuts to scientific research grants focusing on gender and diversity, equity, and inclusion are illegal and discriminatory, a federal judge in Massachusetts ruled yesterday from the bench. “This represents racial discrimination and discrimination against America’s LGBTQ community. That’s what this is,” Judge William G. Young said, adding, “I would be blind not to call it out. My duty is to call it out.” The order comes ahead of a written opinion to be issued later. The Trump administration secured a legal victory yesterday when a federal judge dismissed a lawsuit brought by faculty groups over federal funding cuts to Columbia University. “It is not the role of a district court judge to direct the policies of the Executive Branch first and ask questions later,” Judge Mary Kay Vyskocil wrote in the ruling, adding that the faculty unions had no “standing” to bring the suit and failed to clearly indicate how the administration broke the law. this seems like a pretty big development! no idea what the outcome would be … but nice to see the challenge. Normally we could count on the impeachment process but the republican’ts have their blackmail handcuffs on (to paraphrase tim burchetts odd admission)

"A federal judge ruled yesterday that transgender and nonbinary people who are either without a passport or need to renew one can request a male, female, or “X” identification marker – rather than a marker that matches their gender assigned at birth. The ruling by District Judge Julia Kobick follows Trump’s executive order in January, which rejected the notion that someone can transition from the sex assigned at birth to different gender. Five major U.S. cities have joined a lawsuit against the Trump administration over funding to prevent nuclear attacks and terrorism, alleging the cities have not been reimbursed for the expenses and that funding has not been awarded for 2025. The lawsuit was initially filed by Chicago in May, with the four other cities signing yesterday. “DHS cannot override Congress’s judgment by freezing congressionally appropriated funding,” the lawsuit states. U.S. District Judge John McConnell issued a preliminary injunction barring the government from enforcing the new policy — which he described as “arbitrary and capricious in its scope” — while the lawsuit works its way through court. “Congress did not authorize or grant authority to the Secretary of Transportation to impose immigration enforcement conditions on federal dollars specifically appropriated for transportation purposes,” McConnell wrote. "In a sharp rebuke to the Justice Department, a federal judge yesterday ruled that Kilmar Armando Abrego Garcia should be freed from criminal custody as he awaits trial on human smuggling charges following his wrongful deportation to El Salvador. While Judge Barbara D. Holmes acknowledged that Garcia would likely remain in immigration custody, she ruled that Garcia was neither a flight risk nor a danger to the community. A federal judge in Massachusetts on Friday indefinitely blocked the Trump administration from revoking Harvard University’s ability to enroll international students and scholars.
