    Tuesday TRUMP ADMINISTRATION LITIGATION

    "The Supreme Court yesterday paved the way for the Trump administration to deport immigrants to countries where they are not citizens, temporarily blocking an April 18 decision by a lower-court judge who ruled migrants must have a “meaningful opportunity” to contest their deportation and imposed a nationwide injunction. The justices, without providing an explanation for their ruling, lifted an order from a Boston federal judge who had placed deportation restrictions to countries where immigrants have no ties. A DHS spokesperson celebrated the ruling, saying in a statement, “Fire up the deportation planes.” Following the Supreme Court’s order, the district court ruled that its May 21 order remained in effect for the individual plaintiffs in the case and noted that the Government had not appealed the May 21 order.     For the second time in less than a week, a federal judge in Boston yesterday rejected efforts by the Trump administration to bar international students at Harvard. In a strongly worded ruling, Judge Allison D. Burroughs yesterday blocked a presidential proclamation which bars students from abroad from coming into effect, saying that the case involved “core constitutional rights that must be safeguarded — freedom of thought, freedom of expression, and freedom of speech.” She continued: “The government’s misplaced efforts to control a reputable academic institution and squelch diverse viewpoints seemingly because they are, in some instances, opposed to this administration’s own views, threaten these rights.” Stephanie Saul reports for the New York Times.

    Media Matters for America yesterday sued the Federal Trade Commission and its commissioners arguing the FTC has initiated a “campaign of retribution” in violation of the organization’s free speech protection under the First Amendment. The lawsuit comes amid a federal inquiry into Media Matters’s coverage of advertising practices, with the group receiving a civil investigative demand letter in May relating to a lawsuit filed by Elon Musk. Scott Nover reports for the Washington Post.

    In a hearing yesterday to determine the future of Voice of America, District Judge Royce Lamberth chastised the Trump administration for not complying with his preliminary injunction issued in April. Judge Lamberth said there has been a “paucity” of information provided by the administration about how it is complying with the statutory obligations for running VOA and its parent, the U.S. Agency for Global Media. Following the hearing, the administration and VOA have been asked to make additional filings by next week. After plaintiffs highlighted that VOA has been unable to broadcast on television and only minimally on radio, Lamberth interjected,“What would be the point of Voice of America if there is no voice?” Scott Nover reports for the Washington Post.

    A federal judge in California yesterday said that University of California researchers are likely to succeed on their claims that the Trump administration’s mass termination of research grants involving certain topics including diversity, equity, and inclusion, diversity are unconstitutional. “This is quintessential viewpoint discrimination and that likely violates the First Amendment,” District Judge Rita Lin wrote. The order temporarily blocks the administration from cancelling grants to the University. Jeremy Yurow reports for Courthouse News Service. "

    Wednesday TRUMP PERSONAL LITIGATION 

    In a bid to avoid paying the $83.3 million judgment Trump owes writer E. Jean Carroll for defamatory remarks he made about her after she accused him of sexual assault, Trump’s lawyer yesterday told a federal appeals court that the judgment should be tossed out because, at the time of the lawsuit, “President Trump was denied the protection of presidential immunity.” Citing the Supreme Court’s landmark 2024 immunity ruling, Trump’s attorney argued that the principles behind the immunity ruling also shield Trump from Carroll’s civil lawsuit. The panel appeared skeptical that the Supreme Court’s decision extended to the Carroll case, with Judge Maria Araújo Kahn stating that the court had previously determined that Trump had waived immunity in this case.     TRUMP ADMINISTRATION LITIGATION

    Another person who was deported to El Salvador in violation of a court order must be returned to the United States, a three-judge panel federal appeals court ruled yesterday. The decision marks the fourth ruling since March in which courts have ordered the administration to facilitate the return of immigrants who were deemed illegally or improperly deported. The New-York based Second Circuit Court of Appeals ruled that officials must begin seeking the return of Jordin Meglar-Salmeron, sent to his native country of El Salvador on May 7, “as soon as possible,” and ordered the administration to provide an update next week of his location and the steps officials will take to facilitate his return. A DHS spokesperson said, “The ruling is completely at odds with President Trump’s duty to faithfully execute federal law.” Kyle Cheney and Josh Gerstein report for POLITICO.

    A federal judge yesterday issued a temporary block on Trump’s attempt to terminate the collective bargaining rights for over a million federal employees. Judge James Donato of the U.S. District Court in San Francisco granted the preliminary injunction sought by a coalition of unions whose members would lose their bargaining rights under Trump’s executive order. The ruling conflicts with a May decision by the D.C. Circuit of Appeals, which overturned a different judge’s block on Trump’s order affecting another union’s members. With the unions raising “a serious question as to whether their First Amendment rights have been violated,” Donato said he was halting the executive order pending a trial over its constitutionality.     The Trump administration returned to the Supreme Court yesterday in the case of eight men it seeks to deport to South Sudan. The administration asked the justices to clarify that an order they issued Monday — which permitted the government to send migrants to countries with which they have no connection without the opportunity to argue they would face torture — was intended to also apply to the group of men currently held in Dijbouti.     The Justice Department is suing the entire federal district court bench in Maryland over its standing order requiring an automatic two-day stay in cases involving immigrants who file for habeas corpus. The suit requests the entire Maryland bench recuse itself from the case.     A coalition of Attorneys General from 21 states yesterday sued the Trump administration over billion-dollar funding cuts arguing that the federal government is using an obscure rule to justify the termination of grants. “Congress has the power of the purse, and the president cannot cut billions of dollars of essential resources simply because he doesn’t like the programs being funded,” New York Attorney General Letitia James said.     A lawsuit filed yesterday by civil rights advocates argued that the agreement between Nassau County and ICE agents to conduct immigration arrests violates state law, undermines individuals’ rights, and will result in racial profiling. Carolyn Thompson reports for AP News.

    "A federal judge yesterday granted a preliminary injunction to stop the Department of Labor from shutting down Job Corps until a legal challenge to the effort to wind down the program is resolved. Cathay Bussewitz reports for AP News.

    A grand jury yesterday indicted Ksenia Petrova, a Russian-born Harvard University scientist, on additional charges of concealment of a material fact, making a false statement, and smuggling goods into the United States.     "A family detained in a Texas immigration center on Tuesday filed a lawsuit arguing that their arrest after fleeing Honduras and entering the United States legally using a Biden-era appointment app violated their Fourth and Fifth Amendment rights. The case is believed to be the first lawsuit involving children challenging the administration’s policy on immigrant arrests at courthouses.     "In a Friday ruling, the Supreme Court sharply curtailed the power of district courts to issue injunctions blocking federal government policies nationwide, handing Trump a major victory. In proceedings challenging Trump’s executive order purporting to end the right to birthright citizenship, the Supreme Court split 6-3 to hold that in most cases, judges can only grant relief to the individual parties who brought a particular lawsuit. The majority’s opinion left the door open to wider injunctions in class action lawsuits, and certain cases under the Administrative Procedure Act. In the majority opinion, the Court did not rule on the constitutionality of Trump’s birthright executive order, although the three liberal justices, in dissent, said the president’s order is clearly illegal.     "A federal judge yesterday blocked the Trump administration from revoking the Biden administration’s 2024 extension of humanitarian protections against deportations for up to 500,000 Haitians living in the United States. The judge held that Homeland Security Secretary Kristi Noem’s attempt to let the protections expire effective Sept. 2 was unlawful because it ignored provisions requiring her to give early notice to recipients.     A federal judge yesterday issued an order temporarily restraining the Trump administration from moving forward with the planned reforms of the Health and Human Services Department, finding that Health Secretary Robert F. Kennedy Jr.’s efforts to slash the agency’s headcount and reorient its priorities likely exceeded his authority.     "In an apparent 7-2 vote, the Supreme Court on Thursday lifted a district court order that blocked the Trump administration from deporting eight men detained in a shipping container on a U.S. military base in Djibouti to South Sudan. In an unsigned order, the majority wrote that the district court judge could not “enforce an injunction that our stay rendered unenforceable.” In a dissent joined by Justice Ketanji Brown Jackson, Justice Sonia Sotomayor accused the majority of employing a double standard, writing that “the administration has the Supreme Court on speed dial.” Assistant DHS Secretary Tricia McLaughlin said the deportation flight carrying the deportees landed in South Sudan just before midnight Eastern time on Friday.     "The Trump administration can move forward with its plans to fire tens of thousands of federal workers as the proceedings challenging their dismissals continue, the Supreme Court ruled yesterday. In an apparent 8-1 ruling, the Court granted a stay of a lower court’s injunction blocking the downsizing efforts “because the Government is likely to succeed on its argument that the Executive Order and Memorandum [directing the dismissals] are lawful.” Dissenting, Justice Ketanji Brown Jackson said that her colleagues were inappropriately reinterpreting the lower court’s factual findings.     A federal judge on Monday refused to issue a preliminary injunction that would prevent the Trump administration from rescinding nearly $800 million in grants for programs supporting violence reduction and crime victims, ruling that the court lacked jurisdiction and the organizations had failed to state a constitutional violation or protection. AP News reports.

    The case against a Wisconsin judge accused of helping a Mexican immigrant evade arrest can proceed, a magistrate judge recommended on Monday, writing that “a judge’s actions, even when done in her official capacity, does not bar criminal prosecution if the actions were done in violation of the criminal law.” The accused judge previously argued that her judicial immunity prevents prosecution for actions taken in her official capacity in and around her courtroom.
