    "A federal judge yesterday ruled that the Department of Transportation cannot withhold billions of dollars in funding to states that refuse to cooperate with immigration enforcement conditions. The judge said that the DOT and Transport Secretary Sean Duffy had blatantly overstepped their authority by linking funding for road maintenance and bridges to immigration demands.     Texas. Governor Greg Abbott, a close ally of Donald Trump, made clear with a post on X that anyone from The Big Apple eyeing up The Lone Star State as an 'escape route' would have to pay for the privilege. He posted online: ‘I will impose a 100% tariff on anyone moving to Texas from NYC.’ Legal experts were quick to point out that people cannot be taxed like imported goods.

    Are they going to go so far for a non tax state? Or are they going to a more nearby State like Pennsylvania. Pennsylvania is on the same train system and is more culturally similar but has a lower tax burden. It’s hard to say. John may end up getting a lot of new neighbors.

    Lived many years in NYS and CA.  I decided well over two decades ago that I/we could no longer handle the CA politics.  Sold the planned landing zone home in northern CA and have never looked back.
    Now how I landed in Louisville is a whole 'nother story.

    Thursday TRUMP ADMINISTRATION LITIGATION

    "A federal judge yesterday issued a temporary restraining order requiring immigration officials to provide bottled water, clean bedding, hygiene products, and access to lawyers to detainees at the Broadview ICE facility, near Chicago. The judge gave federal officials until midday tomorrow to submit a report on how they were meeting the 15 requirements set out in his order. Mitch Smith reports for the New York Times.  

    The mood inside the Trump administration yesterday was "grim" following tariff arguments in the Supreme Court, two sources said. During oral arguments, several high court justices appeared skeptical of Trump’s use of the International Emergency Economic Powers Act of 1977 and of arguments that Congress intended to delegate such broad powers to the President. “What would prohibit Congress from just abdicating all responsibility to regulate foreign commerce — for that matter, declare war — to the president?” Justice Neil Gorsuch asked.     Friday TRUMP ADMINISTRATION LITIGATION

    "District Judge Karin Immergut is expected to issue a ruling today on whether the Trump administration violated federal law by deploying National Guard troops to Portland, Oregon, following a three-day bench trial. The decision could mark the first to permanently bar the government from using federal troops to suppress protests against immigration authorities. Jack Queen and Dietrich Knauth report for Reuters.

    District Judge Sara Ellis yesterday granted class-action certification and issued a preliminary injunction, finding that federal immigration officials “lacked credibility” and were likely violating protesters’ constitutional rights in Chicago. Ellis said from the bench that officials had lied about the nature of demonstrations against the Trump administration’s immigration crackdown, citing body camera and aerial footage that “directly contradicted” agents’ testimony. She found that federal agents’ use of tear gas and pepper balls against protesters, journalists, and clergy had chilled free speech, assembly, and religious exercise in violation of the First Amendment. Ellis ordered Border Patrol and immigration agents to give at least two warnings with a “reasonable opportunity” to disperse before deploying riot-control weapons, and declined to stay the injunction pending appeal. A written preliminary injunction followed. The court further orderedthat defendants file by today a verification confirming that Commander Gregory Bovino was issued a body-worn camera on Oct. 31, completed required training, and is currently using the device in compliance with the preliminary injunction.     Maryland and Prince George’s County yesterday sued the Trump administration after the Justice Department, the FBI, and General Services Administration scrapped the previously selected Greenbelt, Maryland, site for a new FBI headquarters and pivoted in July 2025 to the Ronald Reagan Building (RRB) in downtown D.C. The complaint alleges the administration is unlawfully “sabotaging” the Greenbelt site and defying Congress’s instructions to pick among three suburban sites (Greenbelt, Landover, or Springfield."

    Monday TRUMP ADMINISTRATION LITIGATION

    "Supreme Court Justice Ketanji Brown Jackson on Friday evening temporarily halted a lower court order that would have required the Trump administration to fund SNAP payments in full. Tony Romm and Abbie VanSickle report for the New York Times.

    A federal appeals court on Sunday night declined to block an order from a district court judge requiring the Trump administration from paying SNAP payments in full for November. The ruling is on hold due to an earlier order from the Supreme Court on Friday. Josh Gerstein reports for POLITICO.

    Tuesday TRUMP ADMINISTRATION LITIGATION

    "A coalition of green energy groups and the city of St. Paul yesterday filed a lawsuit against the Trump administration challenging the partisan funding cuts to energy programs in Democratic-led states during the government shutdown. The lawsuit names Director of the U.S. Office of Management and Budget Russell Vought as the main defendant. Zach Montague reports for the New York Times.  

    The Justice Department yesterday asked the Supreme Court to block a federal court order requiring the Trump administration to fully fund SNAP payments during the government shutdown. In a filing, the DOJ said that the lower court’s instructions were “massively inappropriate”, adding that conflicting court orders had sowed “upheaval.” It remains unclear whether the Supreme Court will need to rule on the government’s request to block the order as the government shutdown may end this week.     "A federal judge yesterday ordered the release of 13 people on bond who had been detained by the federal government as part of immigration enforcement operations in the Chicago area. The judge also gave Justice Department attorneys a Friday deadline to go through a list of 615 other detainees to see if they qualify for alternatives to detention under a 2022 consent decree while their immigration cases proceed. The judge said he would issue an order for those listed next week. Sophia Tareen reports for AP News."

    "A federal judge yesterday dismissed a Justice Department lawsuit that sought to block a 2020 New York state law that prevents immigration officials from arresting individuals at, or near, state courthouses. The judge rejected the DOJ’s argument that the state law violated the supremacy clause, “a constitutional provision by which federal law supersedes conflicting state laws,” adding that New York was “protect[ing] its sovereign interests in the face of undue federal interference.” Jan Wolfe reports for Reuters

    The Justice Department yesterday filed a lawsuit against California, contending that two state laws signed by Gov. Gavin Newsom (D-CA) in September violated the supremacy clause by attempting to regulate the activities of federal officials. One of the laws forbids federal law enforcement officers from wearing masks as they work, and the other requires federal agents who are not in uniform to wear visible identification during operations.     I really don't think even a new Senator not up for re-election for four more years, will dare vote against releasing the files.  This is the best news I've seen this year.  
     
    EDIT:  And I see the Senate passed it immediately, no roll-call vote for lack of spines.

    Unfortunately the follow-on legal haranging will further delay.  Remember, CHEETO's playbook "Deny, Deflect, Delay."  Filing the suits against the D's mentioned will give the Justice Department reason to redact a whole lot of materials under legal protection.
    Remember, CHEETO could have executive released all this on his own.  
    The delay helped his team design the plan to "look good" but withhold anything of question.

    "Nearly every Republican in the US House of Representatives voted on a bill to compel the release of documents tied to convicted sex offender Jeffrey Epstein.

    The lone "nay" came from the Republican lawmaker from Louisiana, Clay Higgins, who defied his party saying his vote was a principled "NO".

    "What was wrong with the bill three months ago is still wrong today," Higgins wrote on X. "It abandons 250 years of criminal justice procedure in America."

    "A federal judge yesterday temporarily blocked the Trump administration from maintaining more than 2,000 members of the National Guard deployed on the streets of Washington, D.C.. The judge wrote that the deployment appears to be illegal for a variety of reasons, including limits on the president’s authority to assert total control over the D.C. National Guard. The decision also prohibits the use of out of state Guards without local authorities’ consent. Zach Montague reports for the New York Times.

    "A federal judge on Friday blocked the IRS from sharing confidential taxpayer information with ICE, ruling that the prior disclosure to immigration authorities violated taxpayer confidentiality laws. The order requires the agencies to notify the court before any future disclosures. Danny Nguyen reports for POLITICO.

    An appeals court panel on Saturday blocked the Trump administration from expanding its fast-track deportation policy, which would have allowed for the expedited removal of migrants living anywhere in the United States. The 2-1 ruling upheld most of a lower court order, which had previously ruled that the Department for Homeland Security could not enforce policies exposing migrants to rapid expulsion if they had been in the country for less than two years.     "A veteran Justice Department official, Joseph Schnitt, filed a lawsuit yesterday against the DOJ, claiming that his First Amendment rights were violated when Attorney General Pam Bondi fired him in September after a conservative group published a video of Schnitt predicting that the DOJ would take a partisan approach to disclosing the Epstein files. “They’ll redact every Republican or conservative person in those files, and leave all the liberal Democratic people in those files,” Schnitt said in the video.
