Thursday TRUMP ADMINISTRATION LITIGATION
"The Trump administration cannot, for now, proceed with its planned overhaul of the Health and Human Services Department, a federal appeals court ruled yesterday. The court upheld a lower court’s injunction prohibiting mass firings at the agency for the duration of litigation contesting the move and rejected the Trump administration’s claim that states who sued could not show they would be irreparably harmed by the injunction being lifted. Nate Raymond and Daniel Wiessner report for Reuters.
A federal judge yesterday temporarily prohibited the Trump administration from holding immigrants for prolonged periods of time in unsafe and unsanitary conditions at a Manhattan detention center. In his order, the judge said that the plaintiffs are likely to succeed in showing that the conditions in the holding cells violated the First and Fifth Amendments. Luis Ferré-Sadurní reports for the New York Times; Beth Wang reports for Bloomberg Law.
An immigration judge ordered Mahmoud Khalil’s deportation to Algeria or Syria last Friday. The judge denied Khalil’s motion for a waiver preventing his deportation because of misrepresentations made in his application to register permanent residence. In a statement, Khalil remarked that the Trump administration’s “latest attempt, through a kangaroo immigration court, exposes their true colors once again.” Chloe Atkins and Marlene Lenthang report for NBC News. "A federal judge yesterday issued a preliminary injunction extending a block on the Trump administration’s effort to deport hundreds of Guatemalan children. In the ruling, the judge said that U.S. officials’ claims that the children’s return had been requested by their parents had “crumbled like a house of cards” and that based on evidence before the court, it appeared that immigration officials “intend to send back to Guatemala many unaccompanied children without an identified parent or legal guardian there.” A Homeland Security Department spokesperson said the judge “is blocking efforts to REUNIFY CHILDREN with their families” in order to “get Trump.” Josh Gerstein and Kyle Cheney report for POLITICO.
The Justice Department yesterday filed an appeal asking the Supreme Court to allow Trump to fire Federal Reserve board member Lisa Cook.Sam Sutton and Kyle Cheney report for POLITICO.

Tuesday TRUMP ADMINISTRATION LITIGATION
"The Supreme Court yesterday granted the Trump administration’s emergency request to remove FTC member Rebecca Kelly Slaughter until a hearing in December, staying a lower court order that had temporarily reinstated Slaughter in her post. The Court indicated it will consider oral arguments on whether a long-standing Supreme Court precedent limiting the president’s power to fire officials of independent agencies unconstitutionally interferes with the president’s ability to control the executive branch. Josh Gerstein reports for POLITICO; Lydia Wheeler and Jess Bravin report for the Wall Street Journal.
A federal judge yesterday temporarily ordered the Trump administration to recommence the flow of $500 million in funding for scientific research to the University of California, pending a final decision on the issue. In her ruling, the judge said that the government’s indefinite suspension of National Institute of Health grants was “likely arbitrary and capricious.” Eric He reports for POLITICO.
A federal judge yesterday granted a preliminary injunction of the stop-work order imposed by the Trump administration on the Revolution Wind offshore wind project. Escalator Sabotage!
https://youtu.be/js8Ois7X67I?si=Wi61-FUpl89MH9vG
We have to look over some recent, oft-happening "coincidences". Both the escalator, and the teleprompter "malfuntion" at the UN, what are the odds?? And the Army Marching Band's playing of "Fortunate Son" just as they were passing the main stage (during djt's second military parade), followed by drone operators with their controllers strapped on, holding their drones and "zooming" them around with their arms (I felt sorry for those guys).
And, the greatest one of all (if it's true, and I'm not sure); some guy on ewetube explained that British parade horses were trained/bred (bred? how does that work??) to never poop during the parade, but once they got back to a pen with some sh*t off to the corner, they were allowed to relieve themselves via their olifactory senses. Well, just as one was passing Dear Leader he lifted his tail and let loose. Again, no idea about the truth in this, but it sure makes me giggle.“All you need in this life is ignorance and confidence, and then success is sure.”

I don’t understand the Comey witch hunt. The guy basically put a bow on the first election for Trump. Now he has an insurance lawyer, who has never prosecuted a case nor presented a case to a Grand Jury, going after him on a short timeline so as to get in under the statute of limitations. The level of incompetence across this administration is laughable at best and it starts at the top.Large Big Green Egg in a nest. North Shore of Boston.

Thursday TRUMP ADMINISTRATION LITIGATION
"A federal judge yesterday refused to reinstate eight former inspectors general who Trump fired in violation of federal law, ruling that even if the inspectors were reinstated, Trump could move to lawfully remove them again by providing a legally mandated notice and reasons to Congress. The judge opined that inspectors general “deserved better from their government. They still do. Unfortunately, this court cannot provide plaintiffs more.” Chris Cameron reports for the New York Times.
The Trump administration cannot deny disaster relief mitigation money to states that refuse to cooperate with federal immigration enforcement efforts, a judge ruled yesterday. The DHS’ attachment of “sweeping immigration conditions” to the grants was “arbitrary and capricious,” the judge said. Anna Griffin reports for the New York Times."

"A federal judge yesterday issued a preliminary injunction temporarily blocking the Trump administration from deporting dozens of Guatemalan and Honduran children who entered the United States unaccompanied. Monday TRUMP ADMINISTRATION LITIGATION
"The Supreme Court granted an injunction on Friday, allowing the Trump administration to withhold $4 billion in foreign aid previously appropriated by Congress. The majority wrote that based on its “preliminary view” of the case’s merits, the plaintiffs did not have a legal right to bring a lawsuit under the relevant federal statutes. The short, unsigned order on the court's emergency docket was issued over the dissent of three liberal judges. Josh Gerstein and Kyle Cheney report for POLITICO.
Oregon and Portland yesterday sued to block Trump from deploying the state’s national guard, arguing that the move amounts to an unconstitutional abuse of power. “Far from promoting public safety, Defendants’ provocative and arbitrary actions threaten to undermine public safety by inciting a public outcry”, the lawsuit contends. Josh Gerstein and Kyle Cheney report for POLITICO.
The Trump administration on Friday asked the Supreme Court to uphold Trump’s executive order ending birthright citizenship. In a pair of petitions, the government lawyers argued that the Constitution’s promise of citizenship was conferred on “freed slaves and their children, not on the children of aliens temporarily visiting the United States or of illegal aliens.” Abbie VanSickle reports for the New York Times."

There's this today-
A Republican-appointed federal judge handed down a blistering decision on Tuesday condemning Trump and his administration for trampling the free speech rights of foreign students and academics expressing their political views. While Trump was in Virginia at a meeting with generals urging them to use American cities as a “training ground,” US District Judge William Young in Boston said Secretary of Homeland Security Kristi Noem and Secretary of State Marco Rubio and their subordinates acted together “to misuse the sweeping powers” of their offices to target pro-Palestinian non-citizens “primarily on account of the First Amendment protected political speech.” They did so to “strike fear” into other non-citizens backing Palestinian rights, the judge said.Louisville; Rolling smoke in the neighbourhood. "A federal judge yesterday ruled that the Trump administration had used the threat of deportation to systematically silence academics and students who protested in support of Palestinians, violating the first amendment. A federal judge yesterday ruled that the top federal prosecutor in Nevada, Sigal Chattah, is disqualified from handling cases. The judge wrote that Chattah “is not validly serving as Acting U.S. Attorney” and so her involvement in prosecutions “would be unlawful.” Erica Orden reports for POLITICO.
A federal appeals court yesterday agreed to reconsider a ruling that blocked Trump’s use of the Alien Enemies Act to deport immigrants Trump accused of belonging to Venezuelan Tren de Aragua gang. The Supreme Court yesterday refused to allow Trump to immediately remove Gov. Lisa Cook from the Federal Reserve Board. In a brief order, the court did not provide the reasons for its refusal, indicating only that the administration’s application for a stay of a lower court decision preserving Cook’s status is deferred pending oral argument in January 2026. Ann E. Marimow and Colby Smith report for the New York Times; Josh Gerstein reports for POLITICO.
A federal judge yesterday granted an order temporarily restraining the federal government from withdrawing $34 million in funding to protect New York’s transportation system from terrorist attacks. The judge ruled that the state of New York is “quite likely” to prove its allegation that the money was being improperly diverted because the Trump administration wanted to “punish” the state for “exercising its responsibilities in a way that does not satisfy the administration in what it calls the largest deportation mission in history.” Michael R. Sisak and Larry Neumeister report for AP News.
Some migrants held at the Northwest ICE Processing Center in Tacoma, Washington, have the right to request to be released on bond, a federal judge ruled yesterday. And this for a Friday closer:
The health insurance subsidies at the center of the US government shutdown fight disproportionately benefit areas of the country represented by Republican lawmakers, posing a potential vulnerability for President Donald Trump’s party in next year’s midterm congressional elections.
Twelve million Americans in GOP-held US House districts are covered by health plans purchased through Affordable Care Act exchanges established by the 2010 law pushed through by Democratic President Barack Obama. That compares to the nine million living in Democratic-held districts.
We are phqued!

In a moment of clouded clarity MSM (either side) does not lay out the hard facts. There is a clean CR passed by the House (why not go on vacation) sent to the Senate to fund the gubmint thru 11/21. The Senate needs 60 votes to pass the bill (aka some D's).
The D's are locked out over health care language/funding that expires 12/31.
Now vs 12/31?? I'm missing the picture here.

"A group of unions, higher education professionals, religious organizations, and others on Friday filed a legal challenge to the Trump administration’s decision to charge a $100,000 fee on H-1B visas, granted to skilled foreign workers. The lawsuit argues that Trump does not have the authority to unilaterally alter the visa program and that the administration did not go through the required regulatory process to institute the fee. Madeleine Ngo and Hamed Aleaziz report for the New York Times.
A federal workers union on Friday filed a complaint suing the Trump administration over its insertion of blaming Democrats for the government shutdown into Education Department employees' out-of-office email messages. The lawsuit argues that “Forcing civil servants to speak on behalf of the political leadership's partisan agenda is a blatant violation of federal employees' First Amendment rights.” Shannon Bond reports for NPR.
Over 200 international students whose visas were withheld by the Trump administration are suing the State Department to get their visas reinstated, according to court documents reviewed by the Hill. Surina Benkat reports."
