    Friday TRUMP ADMINISTRATION LITIGATION

"A federal judge yesterday blocked the Trump administration from firing Mike Abramowitz, the Voice of America’s director, without the approval of the International Broadcasting Advisory Board. The judge ruled that the Senior Advisor for the U.S. Agency for Global Media, Kari Lake, cannot unilaterally fire Abramowitz, as “the applicable statutory requirements could not be clearer” and require the bipartisan board to approve the termination in a majority vote. Shortly after taking office. Trump dismissed six of the seven members of the board, designed to check political influence on federally funded newsrooms, and has not named their replacements. David Folkenflik reports for NPR.

A full federal appeals court yesterday revised its earlier decision that a group of nonprofits could not challenge the Trump administration’s decision to freeze billions of dollars in Congressionally-approved foreign aid, ruling that the plaintiffs can continue challenging the move in a lower court for a subset of their claims. Zach Montague reports for the New York Times.

The Federal Reserve governor whom Trump tried to fire this week, Lisa Cook, yesterday filed a lawsuit challenging the dismissal. The legal challenge asks the court to rule that removal of a board member “for cause” cannot include “an unsubstantiated allegation” of the sort Trump leveled against her. Kyle Cheney and Josh Gerstein report for POLITICO."

    So much winning…

After a promising estimate in December by analytics company Tourism Economics that the US would see about 9% growth in overall international visitation in 2025, the company’s updated outlook now estimates an 8.2% decline, led by about one quarter fewer Canadians visiting the US from January to July, compared to the same period in 2024.

The World Travel and Tourism Council, a global tourism advocacy organization, projected in May that the United States will lose $12.5 billion in international visitor spending in 2025, the only country out of 184 economies the council analyzed that will see a decline this year.

    Tuesday TRUMP ADMINISTRATION LITIGATION

"A federal judge early on Sunday issued an emergency order halting the Trump administration’s attempts to deport more than 600 unaccompanied Guatemalan children back to their home country. The judge held that the “exigent circumstances” of the case justified the imposition of measures preserving the status quo until a hearing. The children’s advocates said that the government was planning to send them back to Guatemala without notice or a chance to contest their deportation, while the administration’s attorneys described the effort as a “first of its kind pilot program” carried out in cooperation with the Guatemalan government. Kyle Cheney and Josh Gerstein report for POLITICO.

The Supreme Court has made it clear that challenges to grant terminations must be heard by a special tribunal, a federal judge ruled on Friday, dismissing a lawsuit brought by a group of nonprofits whose environmental justice grants were terminated by the Environment Protection Agency. Alex Guillén reports for POLITICO."

@fishlessman- Given you are the resident lobstah roll expert, have you had or do you know of anyone who has had Cousins Maine Lobster rolls?
    Back story here:
Cousins Maine Lobster is a premier seafood franchise bringing authentic Maine Lobster to communities nationwide through its fleet of food trucks, carts, and brick-and-mortar restaurants. Founded in 2012 by cousins Jim Tselikis and Sabin Lomac, the brand started as a passion project and quickly gained national recognition after securing an investment from Barbara Corcoran on Shark Tank. Yep- there is a truck here in the Louisville area and I do enjoy their rolls.  Beats any local reataurant offering.
Likely need a road-trip to Maine to confirm or deny my tastes.

    Wednesday TRUMP ADMINISTRATION LITIGATION

"A federal appeals court yesterday reinstated Rebecca Kelly Slaughter to the Federal Trade Commission, with the majority of the court finding that Trump fired her without cause rather than on the statutory grounds of “inefficiency, neglect of duty, or malfeasance in office.” Slaughter said she plans to resume work at her FTC office starting today. Cecilia Kang reports for the New York Times.

Trump’s deployment of the National Guard and Marines to Los Angeles violated federal law, a federal judge ruled yesterday, finding that the deployment overseen by Defense Secretary Pete Hegseth violated the Posse Comitatus Act, which bars the military from engaging in domestic law enforcement without explicit permission from Congress. Kyle Cheney and Josh Gerstein report for POLITICO.

In a 2-1 decision, a federal appeals court in Texas yesterday ruled that Trump has failed to show that alleged members of the Tren de Aragua gang his administration sought to summarily deport using the Alien Enemies Act mounted an “invasion” or “predatory incursion” against the United States. For this reason, Trump did not have the authority to invoke the Act to carry out the deportations, the majority of the court ruled. Kyle Cheney and Josh Gerstein report for POLITICO.

The potential harm caused by the Environmental Protection Agency’s rescission of unspent funding from the $20 billion “Green Bank” program to organizations that were meant to receive the funding is not irreparable,a federal appeals court ruled yesterday in a 2-1 decision. The majority of the court also found that the “grantees are not likely to succeed on the merits because their claims are essentially contractual, and therefore jurisdiction lies exclusively in the Court of Federal Claims.” The majority lifted a lower court order that prevented the EPA from taking back the money while the litigation plays out. Rachel Frazin reports for the Hill; Alex Guillén reports for POLITICO.

Unions representing the employees of the National Weather Service and U.S. Patent and Trademark Office yesterday filed a lawsuit challenging Trump’s executive order that sought to end the staffers’ collective bargaining agreements with the government. Rachel Frazin reports for the Hill.

Trump yesterday said that he would appeal to the Supreme Court as soon as today a Friday ruling that found many of his tariffs to be illegal, and he would ask the justices to render their decision on an “expedited” timeline. Tony Romm and Ana Swanson report for the New York Times."

ive never heard of them. looking at their locations theres none in maine or northern new england if that says anything.  the good lobster is directly off the boat, anything left in a tank for a couple days loses that seaside freshness. they use the right new england style roll though which is a plus. so that leaves things to frozen which ive never had in a roll, have added it to chowders though.

"The Trump administration has to unfreeze nearly $2.2 billion in federal grants to Harvard, a federal judge ruled yesterday. In her order, the judge wrote that there was “in reality, little connection between the research affected by the grant terminations and antisemitism” at the university, and “review of the administrative record makes it difficult to conclude anything other than that Defendants used antisemitism as a smokescreen for a targeted, ideologically-motivated assault on this country’s premier universities, and did so in a way that runs afoul of the APA, the First Amendment and Title VI.” Gary Grumbach and Marlene Lenthang report for NBC News.

A federal judge yesterday ordered the Trump administration to obligate billions in Congressionally appropriated foreign-aid funds by Sept. 30.POLITICO’s Josh Gerstein reports.

The Justice Department yesterday asked the Supreme Court to quickly hear Trump’s appeal against a judgment striking down his administration’s wide-ranging tariffs and “expedite” its ultimate ruling “to the maximum extent feasible.” In his filing, Solicitor General D. John Sauer asked the court to accept the case by next week and hear arguments in early November. Daniel Desrochers and Josh Gerstein report for POLITICO."

    Friday TRUMP ADMINISTRATION LITIGATION

"A federal appeals court yesterday issued a stay to a lower court’s order to end operations indefinitely at the ”Alligator Alcaraz” immigration detention center in the Florida Everglades, ruling that it was in the public interest for the facility to continue its operations while proceedings are pending. Mike Schneider reports for AP News.

A different federal appeals court yesterday issued a temporary stay on a district judge’s order imposing restrictions on the activities of National Guard troops deployed in Los Angeles, pending a detailed hearing on the issue. The appeals court’s order in effect maintains the status quo, as the lower court judge delayed the entry of his order into force to give the administration time to appeal. Mark Berman reports for the Washington Post

A joint venture between Danish renewable energy giant Orsted and Revolution Wind LLC yesterday filed a lawsuit arguing the Trump administration’s move to halt a nearly finished wind farm off Rhode Island was unlawful and “issued in bad faith.” The Rhode Island and Connecticut Attorneys General indicated they would also file a challenge against the decision. Brad Plumer and Karen Zraick report for the New York Times.

In an emergency filing, the Trump administration yesterday asked the Supreme Court to allow him to fire the Federal Trade Commission’s Rebecca Slaughter. The dispute will likely lead the Supreme Court to consider the vitality of a 1935 ruling that affirmed the constitutionality of a Congress decision to limit the president’s power to dismiss FTC members to cases of “inefficiency, neglect of duty, or malfeasance in office.” Josh Gerstein reports for POLITICO.

The Trump administration yesterday filed a lawsuit against Boston, arguing the city’s “sanctuary” policies that limit police cooperation with immigration enforcement officials are unlawful. Jacob Wendler reports for POLITICO."

Last year, under former President Joe Biden, the economy added an average of 167,000 new jobs each month. Since Trump’s “liberation day” tariffs were rolled out on April 2, the average is a measly 27,000 new jobs a month.

"Federal Reserve Gov. Lisa Cook can, for now, continue serving on the Fed’s Board of Governors while contesting Trump’s attempt to dismiss her from the post, a federal judge ruled yesterday. The judge concluded that Trump’s effort to fire Cook over allegations of mortgage fraud predating her time at the Fed likely violated a federal law intended to insulate the Fed from political pressure. Kyle Cheney, Josh Gerstein, Sam Sutton, and Victoria Guida report for POLITICO.

Chief Justice John Roberts yesterday issued an interim administrative stay of a lower court ruling ordering the Trump administration to pay out $4 billion in foreign aid that had been appropriated by Congress, pending a fuller hearing on the matter on Friday. Adam Liptak reports for the New York Times.

A federal judge yesterday quashed the Justice Department’s subpoena asking the Boston Children's Hospital to share an “astonishingly” broad array of documents related to the facility’s care for transgender minors with the federal government. The subpoena, the judge said, was a “fishing expedition” seeking to give effect to the Trump administration’s political priorities by intimidating the hospital to stop providing gender-affirming and to dissuade patients from seeking it. Nate Raymond reports for Reuters.

The Supreme Court yesterday agreed to hear a pair of challenges to Trump’s use of emergency powers to impose sweeping tariffs on an accelerated schedule, with oral arguments set to be held in the first week of November. In its filings, the Trump administration has previously asked the court to put the case on an expedited schedule. Doug Palmer and Josh Gerstein report for POLITICO."

"Shira Perlmutter can, for now, continue serving as the register of copyrights of the U.S. Copyright Office, a federal appeals court ruledyesterday. The majority of the court held that Trump likely did not have the authority to fire Perlmutter, as she “leads an agency that is housed in the Legislative Branch and her primary role is to advise Congress” and does not exercise significant executive power in her post. Josh Gerstein reports for POLITICO; Michael Kunzelman reports for AP News.

The White House has issued political loyalty tests at the FBI and directly ordered the firings of agents targeted by Trump and his allies, exerting an unprecedented level of influence over decisions at the Bureau, three former FBI agents allege in a lawsuit filed yesterday. The lawsuit accuses FBI Director Kash Patel of dismissing the agents as part of “a campaign of retribution” for their “failure to demonstrate sufficient political loyalty.” Alan Feuer and Glenn Thrush report for the New York Times.

The American Oversight nonpartisan watchdog group yesterday sued the Homeland Security Department over the department’s alleged failure to respond to three FOIA requests concerning Corey Lewandowski's work at the agency. Lewandowski is a special government employee serving as a senior adviser to Homeland Security Secretary Kristi Noem. Brittany Gibson reports for Axios.

"A federal appeals court yesterday allowed the Trump administration to, for now, block the transfers of Medicaid reimbursements to Planned Parenthood, overruling a lower court that ordered the administration to keep funding Planned Parenthood clinics while a lawsuit challenging the funding cuts proceeds. AP News reports.

A federal judge yesterday issued a preliminary injunction temporarily prohibiting the Trump administration from blocking migrants living in the United States irregularly from accessing a number of federally funded services, including Head Start preschools, health clinics, and food banks. A White House spokesperson indicated the administration plans to appeal the ruling. Nate Raymond reports for Reuters.

Attorneys representing the Venezuelans challenging the Trump administration’s attempt to withdraw their Temporary Protected Status yesterday asked a judge to compel the Homeland Security Department to abide by a judgment ordering the protections to be maintained. The attorneys say that despite being ordered to allow the Venezuelans to retain their status last week, the DHS has not updated its website to show that the claimants were still covered by the status, and would not allow many of the claimants to re-register for the status before a Sep. 10 deadline. Allison McCann and Zach Montague report for the New York Times.

The Housing and Urban Development Department has unlawfully coerced applicants for homelessness grants into supporting the Trump administration’s positions on immigration enforcement, transgender rights, and other issues by attaching conditions to the grants, two organizations that support the homeless allege in a lawsuit filed yesterday. Funny how if a judge rules in their favor they demand that ruling is followed, but if they rule against them they just ignore or find another judge.

it is almost like the judicial branch is just a political stormtrooper.  I wonder if any other countries were ever like that?

A bit of insight behind the CHEETO/Agent Orange business acumen, or not:

Trump's casino businesses went through bankruptcy six times between 1991 and 2009, with the debt-restructuring filings impacting four Atlantic City casinos at various times. The bankruptcies were filed by the corporate entities that owned the casinos, rather than by Donald Trump personally.
    Timeline of casino-related bankruptcies
    1991: Trump Taj Mahal
    • Just over a year after opening, the Trump Taj Mahal casino resort filed for Chapter 11 bankruptcy. Its $1 billion construction was mostly financed with high-interest junk bonds, and the casino could not generate enough revenue to cover the massive debt payments.
1992: Trump Castle and Trump Plaza
    • The following year, the corporate owners of two other Atlantic City casinos, Trump Castle and Trump Plaza, also filed for bankruptcy. These filings were part of a broader pattern of over-leveraged debt in Trump's casino ventures.
    • The Plaza Hotel in New York, which Trump owned separately, also filed for bankruptcy in 1992.
2004: Trump Hotels and Casinos Resorts
    • The publicly traded company that managed Trump's casino properties, Trump Hotels and Casinos Resorts, filed for Chapter 11 bankruptcy with about $1.8 billion in debt.
    • Investors lost approximately $500 million in this restructuring.
    2009: Trump Entertainment Resorts
    • The successor company, Trump Entertainment Resorts, filed for bankruptcy again in 2009. At this point, Trump resigned as chairman and lost most of his stake in the company.
    2014: Trump Entertainment Resorts
    • The company filed for bankruptcy a final time in 2014. One executive cited the continued high debt load as the primary cause. The Trump Plaza and Trump Taj Mahal both closed in the years following this filing.
    Factors contributing to the bankruptcies
    • Massive debt: The casino properties were often financed with junk bonds at high interest rates, creating a crippling debt load that was difficult to repay.
    • Overexpansion: The rapid expansion of casino gambling outside of Atlantic City created more competition, making it harder for Trump's casinos to attract enough business to meet their debt obligations.
    • Mismanagement: Reports indicate that Trump pulled large sums of money out of the casinos for himself while the properties consistently posted losses.
    • Poor reputation: Under Trump's management, the casinos developed a reputation for underpayment of contractors and suppliers, as well as for gaudy designs that were unappealing to many high-end customers.

    Monday TRUMP ADMINISTRATION LITIGATION

"The Trump administration’s mass firing of probationary employees earlier this year was illegal, a federal judge ruled on Friday, finding that the terminations came at the direction of the personnel office and not the agencies with the authority to fire employees. The judge did not order the administration to reinstate the fired employees to their jobs, however, as “too much water has now passed under the bridge.” Eileen Sullivan reports for the New York Times.

A federal judge on Friday issued an order temporarily restraining the Department of Housing and Urban Development from changing the rules of a program providing funding to build houses for homeless families and individuals. The nonprofit organizations behind the lawsuit allege the rules change is intended to advance partisan goals. Michael Casey reports for AP News.

The Trump administration’s deportation of a group of African nationals to Ghana “with a wink and a nod” appears to be “truly disingenuous,” a federal judge said during a Friday hearing. The lawyers for the immigrants, who filed a lawsuit challenging the deportations earlier in the day, allege the U.S. officials deported their clients to Ghana only for Ghana to prepare to re-deport them to their countries of origin. The judge ordered the Trump administration to produce any written agreement it has with Ghana to determine what assurances ensuring the people are not redirected to places where they may face torture it has secured. Kyle Cheney and Josh Gerstein report for POLITICO; Chris Cameron reports for the New York Times."

"In a 2-1 ruling, a federal appeals court yesterday rejected Trump’s bid to quickly fire Federal Reserve Gov. Lisa Cook. The majority of the appeals court agreed with a lower court’s finding that Trump’s attempt to fire Cook appeared to have violated her due process rights. The administration has, at the time of writing, not indicated whether it will ask the Supreme Court to intervene on the issue before an interest-rate setting meeting scheduled for today. Tony Romm, Colby Smith, and Ben Casselman report for the New York Times.

A federal judge yesterday said she was not able to offer any help to five West African men the Trump administration recently deported to Ghana. The judge said her “hands are tied,” as even though the men may face the prospect of torture and death in their home countries and have won protection from U.S. immigration court, they are now in the custody of the Ghanaian government. Kyle Cheney and Josh Gerstein report for POLITICO.

Maurene Comey, the daughter of former FBI director James Comey and a former federal prosecutor who handled the Jeffrey Epstein and Ghislaine Maxwell cases, yesterday filed a lawsuit challenging the Trump administration’s decision to fire her without providing an explanation. In her lawsuit, Comey alleges the termination was unmerited, and that she was fired “solely or substantially because her father is former FBI Director James B. Comey, or because of her perceived political affiliation and beliefs, or both.” Erica Orden reports for POLITICO."

Asked by an ABC reporter about the line between freedom of speech and hate speech, Mr. Trump replied: “We’ll probably go after people like you, because you treat me unfairly. It’s hate. You have a lot of hate in your heart. Maybe they’ll come after ABC.”

  • Jake Tapper had a tweet about the Kimmel suspension and some other things in play with the FCC, a proposed $6b deal between two large tv station owners. It mentioned a 39% cap on number of stations owned that the FCC can lift.
