OT: pile on class action suit for lawnmowers

Anybody else receive notice about this $65 mil lawsuit? Talk about a broad base! It applies to anyone who has purchased most any brand of walk behind or riding lawnmowers in the last 16 years! Potentially you COULD get up to $35 for a w/b and $75 for a rider - that's for each as you can file for multiple purchases! Certain brands will receive a little longer warranty, but it will probably be diluted by the sheer number who file claims. Most times I think those suits are a nuisance, but seeing it only took me 2 minutes to file it - what the heck - maybe I'll get a quarter to spend toward a beer!

    Most class actions are to make lawyers richer. I got notice my insurance company was getting sued because they did not give the best rates they could. The lawyers get 6 million the plaintiffs get $8 for each year they had coverage. :unsure: They said you could send a letter to the court so I did asking it to be thrown out.

    I agree! Most times where I encounter them have been with stocks I have owned and most times I pitch them after assessing the probable pennies outcome like you said! OTOH 8 years ago I joined in one for some bank stock I had owned and ended up receiving a settlement check for nearly $9,000! That made more of a believer out of me!

    Had it not been a cold day here today maybe I would not have submitted this claim, but what the heck I did.

    actually you need very little information - I had initially assumed I'd need a sales receipt etc etc which is common "proof" needed for submission, but this claim only asks 5 questions...style, brand, mower serial number, mfg of the motor and lastly the motor model. Obviously the serial # and model will tell them if it was made in the last 16 years.
  • I received one of these also, but I threw it out. In MY opinion, frivilous lawsuits are ruining this great country and I refuse to take part in it. If I am remembering correctly, the lawsuit is over horsepower claims. Come on.

    In general I agree with you and have also pitched many notices to join in a class action suit. What makes this one entirely different is there was no such advance solicitation to join - instead it is an after the fact notification that a number of companies have already agreed and created nearly a $65 million dollar pool to be distributed to people who qualify and who file a claim. In this case whether someone files or doesn't file is a personal decision as you said, but IMHO that doesn't make any one better or worst of a person. I just started this thread as a point of interest and curiosity and by the lack of hits it appears few even care! :laugh:

    it is not what it is claiming - it's already been settled to the tune of $65 mil. The suit was that the horsepower ratings were overstated.

    Mine says, "If you do not want to be legally bound by a Settlement, you must exclude yourself from that Settlement."

    A few years ago I read a John Grisham book titled, King of Torts. In it, 'Grisham takes on the tort lawyers, attorneys who file large class action suits that brings massive payouts from corporations. A few of those dollars make it into the plaintiff's wallets, but huge amounts go to the lawyers who represent them.'

    I'm pretty sure this is a classic example of one such class action suit initiated by an attorney well versed in tort law. And I would normally toss the card, but like what has already been mentioned, the case is already settled (probably for the nuisance value alone) and the money is available for distribution to those who file claims.
