almost looks like a giant bay laurel, never seen a big one, are the leaves soft or somewhat rigid

What color are the flowers if so?

I may be stating the obvious but I wouldn't cook with it unless 100% sure of what it is.

I didn't see it flower but I have only been at this house for 2 month.

It looks like a Swamp Dogwood tree but the leaves seem more glossy than what I see in the photos online.

I say it's a ficus. Bring it inside and see if all its leaves fall off. That's what ours does when we bring it in in the fall.

I pulled up a few pics of live oak leaves; they are certainly not the same as Dave put in his third pics. Randall Lee's photo of a live oak is good. He got that up as I was hunting for this one from google. Hey...I found it, so I've GOT to share it, right

Ok, so my friend who is really into plants just told me it looks like a Camphor tree. I think he's correct.

From more googling: it could very well be a laurel oak (also known as a Darlington oak). Both live oak (Quercus virginiana), and laurel oaks (Quercus laurifolia) are native to Florida. Both species have multiple sub-species that can look sufficiently different to make ID by an amateur difficult. There are a number of "how to tell a laurel oak from a live oak" websites and magazine articles, indicating the common challenge.
Here is one photo showing an example of both types in a single pic.
Here is closeup of a laurel bark from the Pinellas County, FL ag extension agency.
and one of live oak bark from the same place.
Probably the most helpful picture is unfortunately only available in a PDF file, and not easy to download. It is from the Lee County, FL ag extension agency. Here is a screen capture of photo of the bottom side of both types of leaves.
